This Terms of Service (this “Agreement”, “Terms”) is between ProWebCraft LTD (“we”, “us”, “System”, “Platform”, “ProWebCraft” or "Brizy") and the person (“you”, “User” or “Customer”) using our services (“Services” or "Service").

We provide you with access to our System that helps you create websites, manage their content and customisation as well as hosting services. Listed below are the terms and conditions of using our Platform.

Welcome to Brizy!

These Terms of Service ("Terms") govern your access to and use of the Brizy platform (“the Platform”), including its website builder, templates, cloud hosting, WordPress integrations, support tools, documentation, and any other related products or services that reference or link to these Terms (collectively, the "Services").

By accessing or using the Services, you agree to be legally bound by these Terms, forming a binding agreement between you and ProWebCraft LTD ("Brizy", "we", "us", or "our"). If you do not agree to all of these Terms, you must not access or use the Services.

Our Data Processing Addendum is hereby incorporated into and made part of these Terms for users subject to GDPR or similar privacy laws.

Overview

Brizy provides a no-code website building platform that enables users to design, build, and publish websites via a visual editor, with optional integrations for hosting, WordPress, and third-party services. Brizy also offers tools for managing leads, form submissions, and integrations with marketing and analytics platforms.

You may use the Services to create and manage websites for personal or commercial purposes, either directly as an end user or as part of an agency or reseller setup. Users may be granted access via invitations from agency accounts or create their own Brizy account.

By using the Services, you agree to comply with these Terms as well as our Privacy Policy and Data Processing Addendum, which explain how we collect, use, and protect your personal information and content.

You may use Brizy only if you have the legal capacity to form a binding contract and are legally permitted to use the Services in your jurisdiction. Use of the Services by anyone under the age of 16 is strictly prohibited.

These Terms constitute a legally binding agreement between ProWebCraft LTD and its affiliated entities (“Brizy”, “we”, “us”) and you in connection with your access to and use of any Brizy Services. Please read these Terms carefully before using our platform or any of our related tools, integrations, or offerings.

You may access or use the Brizy platform and Services only if you fully agree to these Terms. By registering, creating a website, accessing your account, or otherwise using any Brizy Services, you confirm that you have read, understood, and agreed to be bound by these Terms, as well as any additional legal documents that may apply to your use of Brizy, including our Privacy Policy and Data Processing Addendum.

If you do not accept or understand these Terms, or if you do not have the legal authority to enter into a binding agreement with Brizy, you must immediately discontinue use of all Brizy Services.

Please note that if you are using Brizy as part of an agency, white-label, or reseller arrangement, you are solely responsible for your clients’ use of any websites created using our platform. Brizy does not assume any responsibility for representations made by you to your clients, nor does it accept liability for the content, structure, or compliance of websites built or maintained by you.

By using our Services, you also acknowledge that you have read and understood our Privacy Policy, which describes how we collect, use, and protect your personal data.

We may update or modify these Terms from time to time without prior notice. The latest version will always be available via the “Terms of Service” link on our website. By continuing to use the Services after changes are made, you agree to the revised Terms. If you do not agree with the updated Terms, you should stop using the Services.

If you violate these Terms, Brizy reserves the right to suspend or terminate your account, restrict your access to the Services, or take any other action permitted by applicable law.


I. Using the Services

1.1. Eligibility and Authority

You may use the Brizy Services only if you are at least 16 years of age and have the legal capacity to form a binding agreement. By accessing or using our Services, you represent and warrant that you meet these requirements. If you are under 18, you must have the consent of a parent or legal guardian to enter into this Agreement, and they must review and accept these Terms on your behalf.

1.2. White-Label, Reseller, and API Services

1.2.1. What White-Label Means

Certain Brizy plans may allow an agency, hosting provider, SaaS provider, reseller, or other business customer (a “White-Label Partner”) to make specified Brizy functionality available under its own name, domain, branding, interface, or customer journey.

White-label functionality may be provided through a branded dashboard, embedded functionality, an API integration, account provisioning tools, or another method described in your plan or commercial agreement.

White-label access changes how the Services are presented to End Users. It does not:

  • transfer ownership of the Brizy platform or technology to you;
  • make you the developer or owner of the underlying software;
  • authorise you to grant rights that Brizy has not granted to you;
  • create a partnership, agency, employment, or joint venture between you and Brizy; or
  • authorise you to enter into commitments on Brizy’s behalf.

Brizy may also use third-party technology under the Brizy brand, including technology used to provide Brizy Shops. Brizy’s use of third-party white-label technology is separate from your use of Brizy as a White-Label Partner and is governed by the relevant product-specific provisions.


1.2.2. Your Relationship With End Users

A person or organisation that receives access to the Services through your white-label, reseller, or API implementation is your “End User.”

Unless Brizy expressly agrees otherwise in writing:

  • your End Users contract with you, not with Brizy;
  • you determine the prices and commercial conditions offered to your End Users;
  • you are responsible for billing, refunds, customer service, onboarding, and account administration;
  • you are responsible for all representations and promises made to End Users;
  • you must provide your own terms, privacy information, cookie information, and other legally required notices; and
  • Brizy is not responsible for disputes arising from your relationship with an End User.

You must not state or imply that Brizy has approved, guaranteed, or accepted responsibility for your pricing, service levels, support commitments, business practices, website content, or contractual promises.


1.2.3. Your End-User Terms

Before giving an End User access to the Services, you must ensure that the End User accepts legally adequate terms governing its use of the service.

Your End-User terms must:

  • require lawful use of the service;
  • prohibit content and activities prohibited by these Terms and our Acceptable Use requirements;
  • make the End User responsible for its content, websites, custom code, and published materials;
  • allow accounts, websites, or content to be restricted where required for security, legal compliance, abuse prevention, or enforcement;
  • explain applicable subscription, renewal, cancellation, and refund conditions;
  • contain appropriate privacy, intellectual property, and liability provisions;
  • not grant rights broader than the rights granted to you by Brizy; and
  • not contain commitments regarding Brizy’s functionality, availability, security, support, or performance that exceed the commitments Brizy has made to you.


You remain responsible to Brizy for acts and omissions occurring through End-User accounts that you create, manage, or provision.


1.2.4. Branding and Presentation

You may apply your own branding only to the extent permitted by your selected plan or separate agreement.


White-label rights do not allow you to:

  • copy, sell, license, or distribute Brizy source code;
  • remove legally required notices;
  • misrepresent ownership of the underlying technology;
  • register or use names, domains, or trademarks that infringe Brizy’s rights;
  • use Brizy trademarks without permission; or
  • make modifications that create a security risk or interfere with the Services.


Brizy may require certain technical, security, copyright, regulatory, provider, or legal notices to remain visible, even within a white-label implementation.


1.2.5. Your Interface and Onboarding

Where you integrate Brizy through an API or white-label implementation, you may control parts of the interface, branding, onboarding flow, and information requested from End Users.


Brizy does not control or approve:

  • the wording displayed by you;
  • the information you request from End Users;
  • your registration and onboarding flow;
  • your privacy or consent notices;
  • your commercial representations;
  • your checkout or subscription presentation; or
  • the way you market the service.


You are responsible for ensuring that your interface and onboarding process comply with applicable consumer protection, accessibility, privacy, marketing, and other legal requirements.

This is particularly important for future AI functionality: even where Brizy provides the underlying technology, the partner that controls the interface must ensure that legally required AI notices are visible and are not hidden by the partner’s branding or design.


1.2.6. Feature Availability

Features available through Brizy Cloud, Brizy for WordPress, white-label services, reseller plans, and API integrations may differ.


A feature available in one Brizy product is not automatically included in another product. This includes AI-assisted generation, e-commerce functionality, templates, hosting, integrations, support, and account-management tools.


Only the applicable order, plan description, technical documentation, or written agreement determines which features are included.


Unless AI functionality is expressly enabled for your white-label or API implementation, you must not advertise or represent that such functionality is available.


1.2.7. Support

Unless otherwise agreed in writing:

  • you provide first-line support to your End Users;
  • End Users must contact you regarding account, billing, website, content, or service questions;
  • Brizy provides support to you in accordance with your selected plan;
  • Brizy is not required to provide direct support to your End Users; and
  • any response times mentioned in documentation or support materials are not binding service levels unless included in a signed SLA.


Brizy may communicate directly with an End User where reasonably necessary to investigate fraud, abuse, intellectual property complaints, security incidents, unlawful use, or technical problems.


1.2.8. Personal Data

Where Brizy processes personal data on your behalf in connection with white-label, reseller, or API Services, the processing is governed by the Brizy Data Processing Addendum.


You are responsible for:

  • determining the purposes for which End-User information is collected;
  • establishing a lawful basis;
  • providing appropriate notices;
  • obtaining required consents;
  • ensuring that your instructions to Brizy are lawful;
  • responding to End-User and data-subject requests;
  • configuring access permissions appropriately; and
  • informing End Users about relevant providers, international transfers, cookies, tracking, and automated or AI-supported functionality.


Brizy may separately process limited account, security, fraud-prevention, billing, and service-administration information for its own legitimate purposes, as explained in the Brizy Privacy Policy.


1.2.9. Enforcement

Brizy may suspend or restrict an End-User account, website, or feature where reasonably necessary to:

  • comply with law or a binding request;
  • address fraud, phishing, malware, or other abuse;
  • protect the security or integrity of the Services;
  • prevent harm to Brizy, its providers, or other users;
  • investigate a suspected breach; or
  • enforce these Terms.

Where reasonably possible, Brizy will coordinate such action with the White-Label Partner. Urgent action may be taken without advance notice where necessary to prevent harm, fraud, unlawful activity, or a security incident.

#It’sThatEasy

White-label means that you can offer specified Brizy functionality under your brand. You own the customer relationship and are responsible for what you promise and provide to your End Users. Brizy and its licensors continue to own and operate the underlying technology.

1.3. Service Changes and Access

We reserve the right to modify, suspend, or discontinue parts or all of the Services at any time, with or without notice. This may include changes to features, account eligibility, or available templates. We are not responsible for any losses or damages resulting from such changes.


II. Creating an Account

2.1. Signing Up

To access and use many parts of the Brizy Services, you must first create a Brizy account (“Account”). To register, you must provide a name, valid email address, and a password, and you must accept these Terms, our Privacy Policy, and our Data Processing Addendum. You may also be asked to verify your email or identity in certain cases.

2.2. Account Ownership and Responsibility

The email address used to create the account is considered the official owner of the account. This user has the authority to manage the account, request changes, and receive support through our ticketing system or support forum.

2.3. Unique URLs and Website Creation

When creating a site through Brizy Cloud, you will be assigned a unique Brizy URL for each website. You are responsible for the security, content, and management of each site associated with your account.

2.4. Account Security

You are solely responsible for all activities that occur under your Account, and for maintaining the confidentiality and security of your password and login credentials. Brizy will not be held responsible for unauthorized access, account misuse, or data loss due to your failure to secure your credentials. If you suspect that your account or password has been compromised, you must notify us immediately at support@brizy.io.

2.5. Account Integrity

You agree to provide accurate, complete, and up-to-date information when creating and maintaining your account. Brizy may suspend or terminate accounts that are based on false, misleading, or fraudulent information, or that violate these Terms.

2.6 Account Inactivity

Brizy reserves the right to delete free or inactive accounts, including associated websites and content, after a period of prolonged inactivity (12 months), subject to reasonable notice.


III. Your Content

3.1. Ownership of Content

When you use the Brizy Services to create websites or digital assets, you retain full ownership of all content you upload or create (“User Content”), including but not limited to images, videos, audio files, logos, fonts, text, design elements, code, and any other materials. Brizy does not claim ownership of your User Content.


3.2. License to Operate the Service

By uploading or integrating User Content into Brizy, you grant Brizy (and our third-party service providers acting on our behalf) a non-exclusive, royalty-free, worldwide, sublicensable, and transferable license to use, reproduce, store, modify, display, and distribute your User Content, but only to the extent necessary to:

Host, publish, and maintain your websites;

Provide you with technical support;

Improve and secure the Services;

Enforce our legal rights under these Terms.

This license is solely for the limited purpose of delivering and enhancing the Brizy Services and does not transfer ownership of your intellectual property.


3.3. Prohibited Content

You agree not to upload, post, share, or use Brizy to distribute any content (or to build any website) that:

Promotes or incites physical, psychological, or emotional harm to people or animals;

Exploits or targets minors in any way;

Contains obscene, sexually explicit, harassing, defamatory, or invasive material;

Encourages hate speech, violence, or discrimination based on race, gender, nationality, religion, disability, sexual orientation, or age;

Includes misinformation, false claims, scams, or deceptive content;

Promotes illegal activities or regulated products without proper disclosure;

Violates any intellectual property rights or publicity/privacy rights of others;

Shares confidential information without proper authorization;

Threatens democratic institutions or encourages harmful societal disruption;

Otherwise violates applicable laws or regulations.


3.4. Responsibility for Your Content

You are solely responsible for the integrity, legality, and backup of your content. Brizy does not monitor the content of your website(s), and we are not liable for any damages resulting from content loss, corruption, or unauthorized access. It is your obligation to regularly back up your materials.


3.5. Content Removal and Enforcement

Brizy reserves the right, but not the obligation, to monitor content uploaded to or published via our Services. We may remove, restrict, or delete any content (or suspend or terminate your account) if we reasonably believe it violates these Terms, applicable laws, or our community standards. We are not liable for any resulting loss of content or disruption of service.


3.6. White-Label Use by Agencies

If you are using Brizy as part of an agency or white-label setup, you acknowledge and agree that you are entirely responsible for the User Content and website compliance on behalf of your clients. Brizy acts only as a technology provider and assumes no liability for the content, claims, or legal compliance of client websites created via white-label access.


IV. Your Responsibilities

As a Brizy user, you're responsible for everything you create, upload, or publish using the Brizy Services. By using the platform, you confirm that your content, websites, and activities are lawful and in line with these Terms. Please use Brizy responsibly and ethically, especially when representing content to your end users or clients.


4.1. Only Use Content You Have Rights To Use

You represent and warrant that you either own all rights to your User Content or that you have the necessary licenses, consents, and permissions to upload, publish, and use such content through the Brizy Services. This includes (but is not limited to) images, videos, code, logos, fonts, and written content. You further confirm that our use of your User Content, as permitted under these Terms, will not infringe or violate any third-party rights, including intellectual property, privacy, publicity, or contractual rights.

Do not copy, use, or upload any content to Brizy unless you are legally authorized to do so.


4.2. Comply With Applicable Laws

You agree to use Brizy in accordance with all applicable local, national, and international laws and regulations, including those relating to data protection, consumer rights, sanctions, and export controls. You must not use Brizy to conduct, support, or promote any illegal activity.


4.3. Be Mindful When Sharing Content

Websites and content created with Brizy may be accessible via the public internet or shared through third-party platforms. You are solely responsible for ensuring that any information you make public is appropriate and lawful. Brizy is not responsible for the consequences of content you choose to distribute or publish.


4.4. White-Label and End User Responsibility

If you are using Brizy as part of an agency or reseller account, or in a white-label context, you understand and agree that:

You are fully responsible for the websites, pages, and materials created for your clients (“End Users”);

You are solely responsible for all support, delivery, and legal obligations to those End Users;

Brizy is a backend platform provider and does not interact directly with or assume responsibility for your End Users;

Any liability or claim arising from your client relationships, content, or services lies exclusively with you, not Brizy.


Brizy does not offer legal, regulatory, or commercial advice regarding your End User sites or services.


4.5. Respect Our Acceptable Use Policy

You agree that your use of the Brizy Services and your User Content complies with our Acceptable Use standards. This includes prohibitions on harmful, fraudulent, harassing, illegal, or misleading content. If you breach these standards, Brizy reserves the right to suspend or terminate your account or remove offending content, as described in these Terms.


4.6. Your Custom Code Is Your Responsibility

Brizy allows users to add custom HTML, CSS, JavaScript, and third-party integrations to enhance their sites. Any such customizations are considered part of your User Content. You are solely responsible for ensuring that your code:

  • Does not harm or impair Brizy’s platform or services;
  • Is secure and free from malware or vulnerabilities;
  • Does not violate any applicable laws or third-party terms;
  • Functions as intended and does not interfere with platform performance.

Please note that Brizy does not provide support for troubleshooting or debugging custom code. You should only use this feature if you have the required technical knowledge.


V. Content and Ownership

5.1. Your Intellectual Property

As between you and Brizy, you retain full ownership and intellectual property rights to all User Content that you create, upload, or integrate using the Brizy Services. This includes but is not limited to: images, videos, audio files, fonts, logos, icons, illustrations, artworks, compositions, text, custom code, animations, designs, templates, branding elements, business data, APIs, and any content you or your end users submit or host via the platform.

Brizy does not claim ownership of your User Content.


However, by using the Services, you grant Brizy a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable license to host, use, store, display, reproduce, copy, distribute, and adapt your User Content solely as necessary to:

  • Provide, maintain, and improve the Services;
  • Operate backups and disaster recovery systems;
  • Make formatting or performance adjustments (e.g., resizing images, adapting to screen sizes);
  • Facilitate platform security and compliance processes;
  • Display your websites and related assets to you, your clients, or their end users;
  • Train internal tools and features (e.g., automated layout suggestions, responsive design models), to the extent permitted by law.
  • This license exists only for as long as you use the Services and ends when your User Content is deleted or your account is closed, unless retention is required for legal or technical reasons.
  • You own your content. We just use it to run the platform smoothly.

5.2. Brizy’s Intellectual Property

All rights, title, and interest in and to the Brizy platform, its software, templates, visual elements, backend systems, dashboards, and technology infrastructure — including but not limited to all source code, APIs, algorithms, databases, interface designs, visual themes, layout frameworks, documentation, UX flows, service tools, scripts, logos, trademarks, domains, and proprietary know-how — are and will remain the exclusive property of ProWebCraft LTD or its licensors (collectively, “Brizy IP”).

Subject to your full compliance with these Terms and the timely payment of any applicable fees, Brizy grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Brizy platform and Services for the purpose of building, hosting, and managing websites through your Brizy account or for your clients.

This license does not grant you any ownership or interest in Brizy IP or any of its components. You agree not to:

  • Modify, copy, distribute, sell, license, or publish any part of the platform;
  • Reverse engineer or decompile Brizy software;
  • Use Brizy’s tools or content in a way that competes with Brizy.
  • Some fonts and visual assets available through Brizy may be licensed from third parties. You are responsible for reviewing and complying with the applicable license terms for such third-party assets.

You use the platform; we own the platform.


5.3. Templates and Demo Content

Brizy provides a collection of design templates, layout blocks, overlays, and demo content (collectively, “Templates”) to help you build and visualize websites. These Templates may include placeholder text, stock imagery, graphics, or branding elements ("Demo Content").

Unless explicitly allowed, you may not:

  • Use Demo Content in a live or published website;
  • Redistribute, copy, or extract Templates or Demo Content for use outside the Brizy ecosystem;
  • Use any Brizy Templates in a competing product or service.

All Templates and Demo Content remain the exclusive property of Brizy or its licensors and are licensed to you only for use within the Brizy platform and under the conditions of these Terms.


5.4. Beta Features and Early Access

Brizy may, from time to time, release beta, experimental, or early access features. These features are provided for testing and feedback purposes and may be unstable, incomplete, or subject to change without notice.

By using beta features, you acknowledge that:

  • Brizy provides no guarantees as to functionality, security, or availability;
  • These features may be modified or withdrawn at any time;
  • Support for beta services may be limited or unavailable.
  • Use of beta features is entirely at your own risk.


5.5. Feedback and Suggestions

If you submit any ideas, suggestions, feedback, feature requests, improvements, or any other input related to Brizy or its Services ("Feedback"), you acknowledge that:

  • Brizy exclusively owns all rights to such Feedback;
  • You irrevocably assign any rights you may have in that Feedback to Brizy, including intellectual property rights;
  • Brizy may use, adapt, publish, share, implement, or commercialize the Feedback without acknowledgment, attribution, or compensation to you;
  • You waive any and all current or future claims to moral rights, attribution, or approval regarding the use of your Feedback.


Feedback may be used by Brizy for purposes including, but not limited to:

  • Improving the platform or developing new features;
  • Conducting customer research and product testing;
  • Creating insights, benchmarks, or usage analytics (including aggregated data);
  • Communicating with you or others regarding Brizy updates;
  • Ensuring platform security and performance;
  • Complying with legal or regulatory obligations.


You represent that your Feedback is truthful, lawful, and does not infringe on any third-party rights.


5.6 Brizy’s Rights and Platform Control

Brizy provides a website-building system that includes access to customizable templates (themes), visual design tools, hosting via third-party providers, and content delivery network (CDN) services. While some mockup themes may include stock images, Brizy does not claim ownership over those third-party assets and provides them solely for illustrative or placeholder use.


We reserve the right, at our sole discretion, to modify, suspend, or discontinue any part of the Services, including features, templates, hosting capabilities, or eligibility criteria, at any time, without notice or liability. This includes our right to suspend or terminate access to your account or specific features of the platform if we determine you are in breach of these Terms or other applicable policies.


All published websites on Brizy Cloud are automatically issued HTTPS certificates for secure access. You may not disable or remove HTTPS functionality; certificates are assigned by default to any domain connected through Brizy to ensure best practices in web security and encryption.

VI. AI Services

As part of the Brizy platform, we may offer access to artificial intelligence tools and features that automatically generate or pre-populate website structures, sections, and content to assist you or your clients in building sites more quickly (the AI Services). These features may, for example, create draft pages, headlines, text blocks, or layout suggestions based on basic configuration choices (such as industry, topic, or language), your existing content, or information gathered from public sources, including search engines.

Some Brizy features may include AI-generated content or suggestions to speed up your design process. You remain fully responsible for reviewing and deciding whether to keep, modify, or delete any such AI-generated content.

Certain Brizy Services use artificial intelligence to generate, suggest, transform, or pre-populate website structures, layouts, sections, and text based on the information and materials provided by you.

Depending on the feature used, you may provide prompts, text, documents, images, links, URLs, HTML, JSON, business information, or other materials to the AI Services.

The AI Services are intended to assist with the creation and editing of website content. They are not intended to make decisions about individuals or to be used for employment, education, credit, insurance, access to essential services, medical treatment, law enforcement, immigration, or other decisions that may significantly affect a person’s rights or opportunities.

AI functionality is available only for those Brizy products and plans where it is expressly enabled. AI Services are not included in Brizy for WordPress or in White-Label Services unless Brizy expressly enables them for the relevant product or integration.


6.1. Automatically Generated Content

The AI Services may generate draft websites or content by combining:

predefined templates, layouts, and components made available by Brizy

your existing content, such as your project settings, domain, logo, or text you add to the platform

information obtained from publicly available sources, including search engines, to suggest generic business descriptions, headings, or similar text


You acknowledge that:

  • AI-generated content is automatically produced and may not be accurate, complete, original, or suitable for your specific use
  • similar or identical content may be generated for multiple users
  • AI-generated content may contain errors, outdated information, inappropriate statements, or references to third-party brands, products, or websites

You are solely responsible for carefully reviewing, editing, and validating all AI-generated content before using, publishing, or displaying it on any website, and for removing or modifying any part that is incorrect, misleading, infringing, or otherwise unsuitable.

If you publish AI-generated or AI-manipulated text for the purpose of informing the public about a matter of public interest, you must clearly disclose that the text was generated or manipulated using AI, unless:

  • the content has undergone substantive human review or editorial control; and
  • a natural or legal person assumes editorial responsibility for the published content.

Where you publish AI-generated or AI-manipulated image, audio, or video content that resembles an existing person, object, place, entity, or event and may falsely appear to be authentic or truthful, you must clearly disclose its artificial nature.

Any required disclosure must be clear, distinguishable, accessible, and presented no later than the person’s first exposure to the relevant content.

6.2. Accuracy, compliance, and risk

AI technology is inherently probabilistic and may generate content that is imperfect or inappropriate for your particular context. Accordingly, Brizy does not and cannot guarantee the quality, legality, originality, intellectual property compliance, bias neutrality, or fitness for any particular purpose of any AI-generated content.

You are responsible for:

  • ensuring that all published content on your websites, including AI-generated content, meets your legal, regulatory, contractual, and internal policy requirements
  • informing your clients and end users (where applicable) that parts of the website may have been generated or assisted by AI and should be reviewed before reliance
  • verifying that AI-generated content does not infringe third-party intellectual property rights, misuse trademarks, or violate any applicable laws or industry-specific rules, including those related to marketing, consumer protection, health, finance, and privacy

Brizy disclaims all liability for any consequences, claims, losses, or damages arising from or related to your reliance on, or publication of, AI-generated content.

6.3. Ownership of content

Any content, data, or material you upload or configure in the Brizy platform, including your logos, texts, images, and project settings, is treated as your User Content under these Terms.

As between you and Brizy:

  • AI-generated content that you choose to keep, use, or publish on your websites will also be treated as your User Content, subject to any third-party rights that may apply
  • Brizy does not claim ownership over such content, except where it incorporates Brizy’s own templates, components, or other pre-existing intellectual property, which remain the property of Brizy or its licensors

You are responsible for ensuring that your use of any AI-generated content complies with Section 5 and with all applicable intellectual property and content rules.


6.4. License to Brizy for AI services

To operate, secure, and improve the AI Services and the Brizy platform, you grant Brizy a non-exclusive, worldwide, royalty-free, transferable, and sub-licensable license to:

  • store, process, and display configuration data, draft websites, and AI-generated content within your account and projects
  • analyze how AI-generated content and related features are used in order to maintain, test, and improve the performance and reliability of the AI Services, to the extent permitted by law
  • share such data with approved third-party service providers or subcontractors strictly for the purposes of providing, supporting, or enhancing the AI functionality

Brizy may review AI-related activity for legal compliance, abuse prevention, security monitoring, and troubleshooting. Any processing of personal data within the AI Services will be handled in accordance with our Privacy Policy and applicable data protection laws.


6.5. Third-Party AI Providers

Some AI Services may be powered by third-party providers, and your use of these features is subject to their respective terms and privacy policies, which may be updated independently of Brizy. By using Brizy’s AI features, you agree to comply with any applicable third-party terms and to inform your end users (if applicable) of their obligations when interacting with AI-generated content.

6.5. AI outputs and human review

Content produced by the AI Services, including website structures, sections, headings, descriptions, text, and other suggestions, constitutes draft content.


AI-generated content may be inaccurate, incomplete, outdated, misleading, biased, inappropriate, non-original, or unsuitable for your intended purpose. Similar or identical content may be generated for other users.

You are responsible for substantively reviewing, editing, and approving AI-generated content before publishing or relying on it. Your review should include, where relevant, verification of factual accuracy, intellectual property rights, personal data, regulatory requirements, advertising claims, industry-specific requirements, and the suitability of the content for its intended audience.

A superficial review limited to spelling, grammar, formatting, or visual presentation may not constitute substantive human review or editorial control for the purposes of applicable law.

You remain responsible for the final content published through your website and for any decision to retain, modify, or remove AI-generated content.


6.5. Third-Party AI Providers

Brizy may use artificial intelligence models and related technology supplied by third-party providers.

The current categories of AI features, third-party AI providers, and model families used by Brizy are identified in the Brizy AI Transparency Notice.

Brizy may update or replace an underlying model or provider where reasonably necessary for performance, security, availability, legal compliance, or product development. Brizy will update the AI Transparency Notice to reflect material changes.

Unless expressly stated for a particular integration, the use of a third-party model by Brizy does not create a direct contractual relationship between you and that model provider.


6.6. Machine-readable marking and provenance

Where required by applicable law, Brizy will apply or preserve machine-readable markers, provenance information, or other technical measures intended to make AI-generated or AI-manipulated outputs detectable as such.

You must not knowingly remove, disable, obscure, falsify, or circumvent such markers or technical measures.

Brizy may update its marking and provenance methods to reflect changes in applicable law, technical standards, the generally acknowledged state of the art, or the AI models and providers used by Brizy.

Machine-readable marking does not replace any visible disclosure or label that you may be required to provide to website visitors or other persons.


6.7 Testimonials, reviews, and endorsements

Any testimonial, review, quotation, customer name, rating, profile, endorsement, or similar content automatically generated or pre-populated by Brizy AI is demonstration or placeholder content unless it is based on authentic material supplied and verified by you.

AI-generated sample testimonials are not statements made by actual customers. You must not publish or present them as genuine testimonials, reviews, or endorsements.

You must delete or replace demonstration testimonials before publication and ensure that any testimonial you publish:

  • reflects a genuine statement or experience;
  • is not materially altered or misleading;
  • is used with the necessary permissions; and
  • complies with applicable advertising and consumer protection laws.


Photographs selected from a stock-image provider, including Unsplash, must not be presented as depicting an actual reviewer, customer, employee, or endorser unless that representation is true and lawfully authorised.


6.8 White-label and API integrations

AI Services are not included in Brizy for WordPress or in standard White-Label Services unless expressly identified as part of the applicable plan, order, API documentation, or written agreement.

Where a White-Label Partner or API Partner makes an AI Service available through an interface controlled by that Partner, the Partner must:

  • clearly inform users that they are interacting with an AI system at or before the first interaction;
  • use the disclosure wording or equivalent information specified by Brizy;
  • ensure that the disclosure is clear, distinguishable, and accessible;
  • preserve all machine-readable markers, provenance information, and AI-output indicators supplied by Brizy;
  • not describe or present AI-generated content as necessarily human-created;
  • provide users with the applicable review, accuracy, and publication warnings;
  • enable any visible labelling functionality required for AI-generated content;
  • include appropriate AI provisions in its end-user terms;
  • notify Brizy of significant complaints, misuse, or regulatory requests involving the AI Services; and
  • not use the AI Services for purposes outside their documented intended use.

The Partner is responsible for the design, content, and legal compliance of the parts of the interface, onboarding process, notices, and data collection that it controls.

Nothing in this Section transfers or excludes any obligation that applicable law imposes directly on Brizy.


6.9 Prohibited AI uses

You must not use the AI Services to create or facilitate:

  • phishing, malware, fraud, scams, or deceptive impersonation;
  • fabricated consumer reviews, testimonials, ratings, or endorsements;
  • content falsely presented as originating from a real person or organisation;
  • unlawful discriminatory content or decisions;
  • unlawful manipulation or exploitation of vulnerable persons;
  • content that infringes intellectual property, privacy, confidentiality, publicity, or personality rights;
  • unlawful political, health, financial, legal, or other regulated claims;
  • automated decisions about individuals in areas for which the AI Services are not designed; or
  • any activity prohibited by applicable artificial intelligence, consumer protection, advertising, or other laws.


6.10 Automated safety and abuse detection

Brizy does not routinely conduct manual review of websites or User Content.

Brizy may use automated systems to detect suspected phishing, malware, fraud, scams, harmful activity, security threats, or other potential violations of these Terms.

Limited human review may occur where content is flagged by an automated system, a complaint or legal request is received, or review is reasonably necessary to investigate abuse, protect the Services, enforce these Terms, or comply with law.

Automated detection measures may not identify every violation and may occasionally produce incorrect results. Brizy does not guarantee that unlawful or harmful content will always be detected before publication.


VII. Fees and Subscriptions

7.1. Paid Services and Subscription Plans

Certain features of the Brizy platform are made available as Paid Services under monthly, yearly, lifetime, or agency-based subscription plans. By signing up for a paid plan, you agree to pay all applicable fees (“Fees”) as outlined at the time of your subscription or upgrade.

Brizy offers:

  • Monthly, yearly or lifetime subscription options for Brizy Cloud
  • Yearly or lifetime license options for Brizy for WordPress
  • Free account tiers, which may be terminated at any time at Brizy’s sole discretion


All Fees are billed in advance of the applicable billing period and are non-refundable except as expressly stated in these Terms or required by applicable law.

Brizy reserves the right to modify, suspend, or terminate Free accounts or delete content from Free accounts at any time, with or without notice. Brizy disclaims any liability for loss of content from Free account websites.


7.2. Payment Terms

All fees for access to Brizy’s Paid Services are stated in United States Dollars (USD) and are exclusive of any applicable taxes, including but not limited to sales tax, value-added tax (VAT), goods and services tax (GST), or any other applicable charges imposed by governmental authorities. These taxes are your sole responsibility and will be added to the total amount due where required by law.

VIII. Brizy Shops and E-Commerce Services

8.1. What Brizy Shops Is

Brizy Shops is an optional, separately priced e-commerce add-on that may be activated for eligible Brizy Cloud websites. Depending on your selected plan, Brizy Shops may allow you to create and manage a product catalogue, shopping cart, checkout, orders, inventory, shipping options, taxes, discounts, subscriptions, and other e-commerce functionality.


An active Brizy Cloud subscription may be required to use Brizy Shops. Available features, product limits, usage limits, supported countries, and pricing depend on the plan selected by you and will be displayed when you activate or purchase the add-on.


Parts of Brizy Shops are provided using third-party commerce technology integrated into the Brizy platform. The current underlying commerce technology provider is Ecwid by Lightspeed, or another provider identified in our Third-Party Provider or Subprocessor List (the “Commerce Technology Provider”).


Brizy provides the website-building environment, design tools, integration, and access to Brizy Shops. The Commerce Technology Provider supplies or supports parts of the underlying commerce engine.


8.2. Your Brizy Shops Subscription

Unless we expressly tell you otherwise when you activate Brizy Shops, your subscription to Brizy Shops is purchased from Brizy and is governed by:

  • these Terms;
  • the plan and pricing information presented at purchase;
  • any Brizy Shops-specific terms displayed during activation;
  • our Privacy Policy and Data Processing Addendum; and
  • any additional terms that are expressly identified as applicable to a particular commerce, payment, shipping, marketplace, or other third-party feature.


Where additional third-party terms must be accepted for a specific feature, they will be presented or linked to you when reasonably practicable. Nothing in this Section makes Brizy the seller of the products or services offered through your Shop.


8.3. You Are Responsible for Your Shop

You, and not Brizy, are the merchant and contracting party in relation to the products or services offered through your Shop, unless you clearly identify another lawful merchant to your customers.


You are solely responsible for:

  • deciding which products or services to offer;
  • ensuring that your products and services are lawful, safe, accurately described, and suitable for sale;
  • setting prices, currencies, discounts, and commercial conditions;
  • maintaining accurate product, stock, and availability information;
  • processing and fulfilling orders;
  • dealing with customers and providing customer support;
  • arranging shipping, delivery, collection, and fulfilment;
  • managing cancellations, returns, refunds, warranties, and chargebacks;
  • issuing invoices, receipts, and other legally required documents;
  • calculating, collecting, reporting, and paying applicable taxes, customs duties, and other charges;
  • complying with consumer protection, product safety, accessibility, advertising, marketing, sanctions, export control, and industry-specific requirements; and
  • complying with any rules imposed by payment providers, marketplaces, shipping providers, or the Commerce Technology Provider.


Brizy does not become a party to the contract between you and a person purchasing from your Shop (a “Shopper”).


8.4. Products and Services You May Sell

You must not use Brizy Shops to advertise, offer, sell, or facilitate the sale of any product or service that:

  • is unlawful in the country from which you operate or the country into which it is sold;
  • violates Brizy’s Acceptable Use requirements;
  • infringes another person’s intellectual property, privacy, publicity, or other rights;
  • is fraudulent, misleading, unsafe, or materially different from its description;
  • requires a licence, registration, authorisation, age verification, or other approval that you do not possess;
  • is prohibited or restricted by the Commerce Technology Provider, a payment provider, marketplace, or other provider used by your Shop; or
  • exposes Brizy, its providers, or other users to an unreasonable legal, security, reputational, or financial risk.


We may restrict or suspend a Shop where we reasonably believe that prohibited or unlawful products are being sold, or where a payment provider, Commerce Technology Provider, governmental authority, or other authorised party requires us to do so.


8.5. Your Terms and Information for Shoppers

Before accepting orders, you must provide Shoppers with all information and policies required by applicable law. Depending on your activities and location, this may include:

  • your legal or trading name and contact information;
  • terms and conditions of sale;
  • product and pricing information;
  • payment conditions;
  • delivery and shipping information;
  • cancellation and withdrawal rights;
  • return and refund policies;
  • warranty information;
  • privacy and cookie notices; and
  • any mandatory product, trader, tax, safety, or regulatory information.

You must configure your checkout and consent settings appropriately and make sure that Shoppers can access the relevant terms and policies before completing a purchase.


Your own store policies govern your relationship with your Shoppers. These Brizy Terms govern your use of the Brizy platform and do not replace the terms that you must provide to your customers.


Ecwid’s own documentation similarly provides functionality for merchants to add legal pages and, where appropriate, require shoppers to accept them at checkout. Ecwid Help Center


8.6. Payments

Brizy Shops may allow you to connect payment providers or payment methods made available by the Commerce Technology Provider or other third parties.


Unless expressly stated otherwise for a particular payment service:

  • Brizy does not process or hold payments made by Shoppers;
  • Brizy is not the merchant of record for your sales;
  • payments are processed under the payment provider’s own terms;
  • payment processing fees, currency conversion fees, chargeback fees, or other provider charges may apply separately from your Brizy fees; and
  • you are responsible for completing any identity, business, banking, tax, or verification requirements imposed by the payment provider.


Brizy does not guarantee that a payment will be authorised, settled, refunded, or protected against fraud or chargebacks.


You must not collect or store payment-card details through ordinary Brizy forms, custom fields, uploaded documents, or website content. Payment-card information must be collected only through an authorised and properly configured payment provider.


8.7. Taxes, Shipping, Marketplaces, and Other Commerce Features

Tax, shipping, marketplace, point-of-sale, subscription, advertising, and similar tools may be supplied by third parties and may be available only in certain plans, countries, or currencies.

Any automated calculation, estimate, suggestion, or configuration provided through Brizy Shops is a technical tool only. You remain responsible for verifying that the settings and results are correct for your business.


Brizy does not provide legal, tax, accounting, customs, shipping, or regulatory advice.


8.8. Shop and Shopper Data

Using Brizy Shops may involve the collection and processing of information relating to Shoppers, orders, products, deliveries, payments, communications, and transactions.


You are responsible for:

  • determining which information you need to collect;
  • providing an appropriate privacy notice;
  • establishing a lawful basis for processing personal data;
  • obtaining any legally required consents;
  • limiting access to authorised persons;
  • configuring cookies and tracking technologies appropriately;
  • responding to data-subject requests;
  • applying appropriate retention periods; and
  • ensuring that information entered into Brizy Shops is accurate, relevant, and limited to what is necessary.


The respective data protection roles of you, Brizy, and the Commerce Technology Provider are described in the Brizy Privacy Policy, Data Processing Addendum, and applicable third-party documentation.


Depending on the functionality used, a third-party provider may act as:

  • a subprocessor used by Brizy;
  • a processor engaged directly by you; or
  • an independent controller for its own activities, such as fraud prevention, payment compliance, or account verification.


You must not upload sensitive or special-category personal data to product descriptions, order notes, custom fields, or other Shop areas unless this is strictly necessary, lawful, and supported by appropriate safeguards.


8.9. Third-Party Commerce Technology

The availability and operation of some Brizy Shops features depend on the Commerce Technology Provider and other third-party providers.

Features may be affected by:

  • changes to third-party APIs;
  • provider-imposed limits;
  • changes in supported countries or payment methods;
  • technical or security updates;
  • changes required by law;
  • third-party outages; or
  • the discontinuation of a third-party service.


Brizy may update, replace, or reconfigure the Commerce Technology Provider where reasonably necessary. Where a change materially reduces the core functionality of a paid Brizy Shops plan, we will provide reasonable notice where practicable and required by law.


If Brizy permanently discontinues the core Brizy Shops service during a prepaid subscription period and does not provide a materially equivalent replacement, you will be entitled to a proportionate credit or refund for the unused part of that prepaid period, except where the discontinuation results from your breach or circumstances outside Brizy’s reasonable control.


8.10. Fees, Trials, and Additional Charges

Brizy Shops fees are separate from the fees payable for your underlying Brizy Cloud subscription unless expressly included in your plan.


Your Brizy Shops subscription will renew, cancel, or expire in accordance with the subscription information presented at purchase and Section 7 of these Terms.


A free trial may have limited functionality. For example, live checkout, order placement, payment processing, or other commerce functionality may be disabled until you activate a paid plan.

Fees charged by payment providers, marketplaces, shipping providers, app providers, or other third parties are not included in Brizy Shops fees unless expressly stated.


8.11. Suspension, Cancellation, and Existing Customer Obligations

We may suspend or restrict Brizy Shops where:

  • applicable fees remain unpaid;
  • your use creates a security or technical risk;
  • your Shop violates these Terms or applicable law;
  • prohibited products or services are offered;
  • a provider requires suspension;
  • fraud or abuse is reasonably suspected; or
  • suspension is necessary to protect Brizy, Shoppers, providers, or other users.


Where reasonably possible, we will notify you and give you an opportunity to correct the issue before suspension. Immediate suspension may be necessary in serious, urgent, fraudulent, unlawful, or security-related cases.


When your Brizy Shops subscription ends:

  • the storefront, checkout, order-management, or other commerce functionality may become unavailable;
  • you should export any data that you are entitled and technically able to export before termination;
  • data will be retained or deleted in accordance with our Privacy Policy, Data Processing Addendum, and applicable legal requirements; and
  • you remain responsible for outstanding orders, refunds, returns, warranties, customer requests, taxes, records, and any other obligations arising before termination.

Cancellation of Brizy Shops does not automatically cancel contracts, recurring purchases, or other obligations between you and your Shoppers.


#It’sThatEasy: Brizy gives you the tools to create the storefront. You run the Shop and remain responsible for what you sell, your customers, and your legal obligations. Parts of the commerce technology are powered by specialised third-party providers.


Pricing Structure and Tailored Offers

Brizy provides access to Paid Services via standard subscription tiers as published on the Website. In certain cases, Brizy may offer customized plans or individually negotiated pricing (collectively, "Tailored Pricing") for specific customers, agencies, or enterprise users. Tailored Pricing must be documented in writing and approved by Brizy. Unless otherwise specified in writing, all terms applicable to standard pricing plans also apply to Tailored Pricing agreements.

By subscribing to a standard plan or accepting a Tailored Pricing offer, you agree to pay the amount shown at the time of purchase or as specified in your tailored agreement. You further acknowledge that pricing may vary based on selected features, usage levels, service locations, billing frequency, or promotional discounts, and that Brizy reserves the right to revise its pricing at any time. However, any pricing change will only apply prospectively to future billing cycles and will not affect fees for ongoing subscriptions unless otherwise agreed in writing.


Billing and Payment Authorizations

Payment for Paid Services is due in advance and must be processed through Brizy’s approved third-party payment providers. By submitting your billing information, you authorize Brizy and its designated processors to (a) charge the total fees, including recurring subscription amounts and applicable taxes, to your selected payment method, and (b) store your payment information securely for automated renewals or future transactions.

For recurring services, your selected subscription will automatically renew at the end of each billing cycle unless you cancel prior to the renewal date, in accordance with Section 7.3. If you upgrade your subscription, the difference in fees will be charged immediately on a prorated basis. If you downgrade or cancel your subscription, the change will take effect in the next billing cycle unless explicitly stated otherwise.


Responsibility for Payment

You are solely responsible for ensuring the accuracy and validity of your billing information, including maintaining an active and funded payment method. If a payment fails, is reversed, or is rejected for any reason, Brizy reserves the right to:

  • Immediately suspend or terminate access to Paid Services;
  • Re-attempt the payment method on file;
  • Request updated billing credentials;

Initiate collection proceedings for unpaid fees, including interest and legal costs where permitted by law.

Failure to remit timely payment may also result in the loss of promotional rates, discounts, or access to legacy pricing structures.


Confirmation and Invoicing

Upon successful processing of payment, Brizy will issue an electronic receipt or invoice to your registered email address or billing dashboard. This documentation will serve as official confirmation of payment and may include tax identification numbers or other invoicing requirements upon request.


7.3. Auto-Renewals and Cancellation

To prevent interruptions, Paid Services are set to automatically renew at the end of each subscription term for the same duration (e.g., monthly or annually), unless you explicitly cancel before the renewal date. You can cancel auto-renewal from your Brizy account settings at least 24 hours prior to the renewal period.

If not canceled in time, your subscription will renew at the then-current fee. Discounted or promotional prices may revert to full standard rates after the initial promotional term ends.

You may cancel your Paid Services at any time; however, unless a refund is expressly provided, your cancellation will take effect at the end of the current subscription period. No partial refunds are given for unused portions of paid terms.


7.4. Refunds

Brizy offers a 30-day refund policy for new monthly or yearly subscriptions. Refunds are not available for:

Renewals of existing subscriptions

Lifetime licenses

Additional purchases, add-ons, or custom services

Services not purchased directly through brizy.io

If you qualify for a refund, it will be issued in the original payment currency. Please note that Brizy is not responsible for differences caused by currency exchange rates or fees from third-party payment processors.


7.5. Chargebacks

If you initiate a chargeback with your bank or credit card company for a fee legitimately charged by Brizy, this will be considered a breach of your payment obligations. Brizy reserves the right to:

Immediately terminate or suspend your account

Permanently restrict re-registration

Delete all content associated with your account


You will remain liable for all outstanding fees, as well as any dispute-related expenses incurred by Brizy. We strongly encourage you to contact our support team first before initiating a chargeback.


7.6. Third-Party Payment Processors

Brizy uses third-party payment processors (e.g., Stripe, PayPal) to process payments. Your payment information is handled in accordance with those providers’ respective terms and privacy policies. Brizy disclaims any liability related to such third-party processing and is not responsible for additional bank fees, currency exchange charges, or cross-border transaction costs.


7.7. Fair Use and Reseller Responsibility

You agree to use the Services fairly and within reasonable bandwidth, storage, and API limits applicable to your subscription. Excessive or abusive use may result in account restriction or additional charges.


If you are a Reseller or Agency, you are solely responsible for managing client accounts, payments, and terms with your customers. Brizy is not liable for client service disputes, subscription misuse, or support expectations arising from white-label usage.


7.8. Special Offers and Promotions

From time to time, Brizy may make available limited-time promotions, discounts, trial periods, sales campaigns, or other special offers (collectively, Promotions). All Promotions are subject to these Terms and any additional conditions presented on the relevant promotional page or communication. In case of conflict, the specific conditions of the Promotion will prevail for the duration of that offer.


Promotions are available only for the period explicitly stated and may be modified or withdrawn at any time. Availability may be limited by factors such as geographic region, eligibility criteria, account status, or usage restrictions. Unless expressly indicated, Promotions apply only to new purchases and do not affect existing subscriptions, renewals, Tailored Pricing agreements, or previously applied discounts.


Participation in a Promotion does not guarantee future pricing, discounts, or continued access to the same terms once the promotional period ends. Any Fees payable after the end of a Promotion will revert to the applicable standard rates unless otherwise specified in writing.


7.9. Service levels and exclusions

Unless you have entered into a separate written service level agreement (SLA) signed by Brizy, the Services are provided on a commercially reasonable efforts basis only. No uptime guarantees, performance commitments, service credits, priority support, or remedies of any kind apply to your subscription. Any descriptions of availability, maintenance practices, or support responses are for informational purposes and do not constitute binding service levels or contractual commitments.

VIII. Third-party services and integrations

Brizy works with trusted third-party service providers to deliver core parts of the Platform, including hosting, analytics, payments, email delivery, AI content generation, design tools, and optional integrations made available through the Services (Third-Party Services). These providers operate under contractual obligations consistent with applicable privacy and security laws, as described in our Privacy Policy. However, Brizy does not control or endorse the terms, availability, performance, or practices of these Third-Party Services, and your use of them is at your sole discretion and risk.


8.1. Use of Third-Party Services

Some features of the Platform require or offer optional connections to Third-Party Services, including:

  • analytics and monitoring tools
  • AI content generation
  • marketing, CRM, and email delivery tools
  • payment processors and billing providers
  • design, collaboration, and hosting infrastructure
  • domain registration, DNS, and SSL providers
  • social login integrations (e.g. Google, LinkedIn)
  • forms, survey tools, and embedded scripts provided by third parties


When you enable, embed, or connect any Third-Party Service to your website or account, you acknowledge and agree that:

  • the Third-Party Service is governed exclusively by that provider’s terms and privacy policy;
  • Brizy does not monitor, control, or assume responsibility for Third-Party Services;
  • your use of such Third-Party Services may involve the transfer of data to those providers;
  • you are solely responsible for reviewing and complying with the applicable third-party terms, privacy notices, and cookie rules;
  • Third-Party Services may place cookies, scripts, tags, analytics technologies, or similar tools on your websites, for which you are solely responsible toward your end users.

8.2. Brizy’s role as technical facilitator

If you choose to use or integrate Third-Party Services through the Platform, Brizy acts only as a technical facilitator. Brizy does not:

  • control the functionality, accuracy, or availability of Third-Party Services;
  • become a party to any agreement between you and a third-party provider;
  • validate or audit the compliance of Third-Party Services;
  • assume liability for outages, breaches, data loss, or non-compliance caused by Third-Party Services.

Any issues, claims, or disputes arising from your use of Third-Party Services must be addressed directly with the relevant provider.


8.3. Responsibility for third-party scripts, code, and plugins

If you add external code, plugins, widgets, tracking tools, marketing scripts, or integrations to your Brizy websites, you are solely responsible for ensuring that such additions:

  • are lawful, secure, and technically compatible with the Platform;
  • do not harm or interfere with the Services;
  • do not violate privacy, cookie, consumer protection, or industry-specific laws;
  • are covered by proper disclosures, consents, or cookie banners required in your jurisdiction;
  • are removed or disabled if they create security risks or violate these Terms.
  • Brizy does not provide support, auditing, or verification for any third-party code you choose to add.


8.4. Third-party outages and data loss

Brizy is not responsible for:

  • downtime, errors, or service interruptions caused by Third-Party Services;
  • changes to third-party APIs, features, or pricing;
  • data loss, corruption, or unauthorized access occurring within Third-Party Services;
  • financial losses, reputational damage, or legal claims arising from your reliance on Third-Party Services.

To the maximum extent permitted by law, any warranties or assurances regarding Third-Party Services are expressly disclaimed.


8.5. Sub-processors and infrastructure providers

Brizy uses a limited number of trusted sub-processors and infrastructure providers (such as AWS, payment processors, analytics vendors, and support tools) to deliver the Services. These are listed in our Privacy Policy and may be updated from time to time.

Brizy ensures these providers are bound by data protection agreements consistent with GDPR and UK GDPR, but Brizy cannot guarantee their performance or availability.

Your continued use of the Services constitutes acceptance of Brizy’s current list of approved sub-processors.


8.6. Third-party links and external websites

The Services may contain links to third-party websites, platforms, or resources. Such links are provided for convenience only, and Brizy does not endorse or control the content, policies, or practices of any third-party site. You access such sites entirely at your own risk.


IX. Warranty and Disclaimer

THE SERVICES, AND THE INFORMATION ON OR AVAILABLE THROUGH THE SERVICES, IS PROVIDED ON AN “AS IS” BASIS WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OR CONDITION OF MERCHANTABILITY, MERCHANTABLE QUALITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE, REPRESENT OR WARRANT THAT YOUR USE OF THE WEBSITE, WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. WE DO NOT WARRANT THAT THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE. YOU AGREE THAT FROM TIME TO TIME WE MAY REMOVE THE WEBSITE FOR INDEFINITE PERIODS OF TIME OR CANCEL IT AT ANY TIME WITHOUT NOTICE TO YOU. TO THE FULLEST EXTENT PERMITTED BY LAW, WE EXCLUDE ALL REPRESENTATIONS AND WARRANTIES RELATING TO OUR WEBSITE, OR RELATED CONTENT, FOR WHICH IS OR MAY BE PROVIDED BY ANY AFFILIATES OR ANY OTHER THIRD PARTY, INCLUDING IN RELATION TO ANY INACCURACIES OR OMISSIONS IN THE SERVICES OR OUR LITERATURE.

THE FOREGOING DOES NOT AFFECT ANY WARRANTIES THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

You may be given access to Confidential Information of Brizy, its affiliates and other third parties. You may use Confidential Information only as needed to use the Services as permitted under these Terms. You may not disclose Confidential Information to any third party, and you will protect Confidential Information in the same manner that you protect your own confidential information of a similar nature, using at least reasonable care. Confidential Information means nonpublic information that Brizy or its affiliates or third parties designate as confidential or should reasonably be considered confidential under the circumstances, including software, specifications, and other nonpublic business information. Confidential Information does not include information that: (i) is or becomes generally available to the public through no fault of yours; (ii) you already possess without any confidentiality obligations when you received it under these Terms; (iii) is rightfully disclosed to you by a third party without any confidentiality obligations; or (iv) you independently developed without using Confidential Information. You may disclose Confidential Information when required by law or the valid order of a court or other governmental authority if you give reasonable prior written notice to Brizy and use reasonable efforts to limit the scope of disclosure, including assisting us with challenging the disclosure requirement, in each case where possible.


(4) Your Personal Data

We generally retain your personal data for as long as your account is active and for an additional 3 years after your account becomes inactive. This retention period allows us to comply with applicable legal and contractual obligations, maintain accurate records for audit and compliance purposes, and ensure we can provide proof and evidence concerning our relationship, should any legal issues or disputes arise following the discontinuation of your use of the Service. XI. Marketing Communications

11.1. Overview

Brizy may contact you with marketing-related communications by email or other electronic means to keep you informed about relevant updates, new features, service offerings, webinars, promotions, and other news related to our platform. These communications may be personalized based on your usage, preferences, and interactions with our Services.


11.2. Legal Basis

We rely on the following legal grounds under the General Data Protection Regulation (GDPR) and related laws to send you marketing communications:

Legitimate Interest – If you have registered for an account, requested a demo, downloaded resources, or purchased our Services, we may send you relevant information that helps you use the Services more effectively, such as onboarding materials, service tips, product updates, or similar offers. This is done in accordance with Article 6(1)(f) GDPR.

Consent – Where legally required (e.g., for newsletters not tied to an existing relationship), we will ask for your explicit opt-in consent under Article 6(1)(a) GDPR before sending promotional emails or campaign materials. You may withdraw consent at any time.

11.5. Marketing on Behalf of Resellers or Agencies

If you are accessing Brizy through a reseller, agency, or white-label arrangement, they may contact you directly regarding products or services offered under their brand. In such cases, marketing communications will be subject to their privacy practices, and Brizy is not responsible for such outreach. Please contact the respective party to manage your preferences.


11.6. Use of Data for Marketing Optimization

We may use aggregated and pseudonymized user behavior data (e.g., email open rates, link clicks, feature usage patterns) to refine our campaigns and ensure communications are relevant and useful. We do not use this data for profiling in a way that produces legal effects or similarly significant decisions.

XII. Indemnification 

To the fullest extent permitted by law, and except to the extent arising from our gross negligence or intentional misconduct, you agree to indemnify, defend, and hold harmless us, and our employees, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, from any claim or demand, including reasonable attorneys’ fees made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or rights of a third party. We reserve the right to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you shall cooperate with us in asserting any available defenses. You shall not settle any actions or claims on our behalf without our prior written consent.

If you are a California resident or resident of a state with a similar applicable law, you hereby expressly waive California Civil Code section 1542 in connection with the foregoing (or such other similar applicable law in your state), which states: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party.”


XIII. Severability

If any provision of these Terms will be found to be unlawful, void or unenforceable, then such provision shall be removed without affecting the enforceability of all remaining provisions. 


XIV. Termination

These Terms are effective until terminated. We may terminate these Terms at any time without notice to you and may deny you access to our Services. You may terminate these Terms at any time for any reason by discontinuing the use of the Services.


XV. Arbitration and Dispute Resolution

You and Brizy agree to resolve any claims relating to these Terms or our Services through final and binding arbitration, except that you have the right to opt out of these arbitration terms, and future changes to these arbitration terms, by emailing support@brizy.io within 30 days of agreeing to these arbitration terms or the relevant changes.

We would like to understand and try to address your concerns prior to formal legal action. Before filing a claim against Brizy, you agree to try to resolve the dispute informally by sending us notice at support@brizy.io of your name, a description of the dispute, and the relief you seek. If we are unable to resolve a dispute within 60 days, you may bring a formal proceeding. Any statute of limitations will be tolled during the 60-day resolution process.

These Terms are governed by the laws of the United Kingdom. Any disputes not subject to arbitration shall be resolved in the courts located in London, England.


XVI. Notices

All communications shall be made in writing. We reserve the right to send notifications to you through the information supplied during registration or the email address associated with your utilization of the Services.


XVII. Changes to these Terms

We reserve the right to change, modify, or amend these Terms at any time to reflect changes in our practices and service offerings. If we modify our Terms, such changes will be effective upon posting. It is your obligation to check our current Terms for any changes. These Terms may only be modified in writing. Any ambiguities in the interpretation will not be construed against the drafter.

XIX. Region-Specific Terms

Depending on where you are located, where the Services are supplied or used, and whether mandatory local law applies, certain additional laws and rights may apply to you. This section describes certain provisions applicable in the United States, United Kingdom, European Economic Area, and Australia. It does not provide an exhaustive description of all local laws that may apply.

19.1. United States

If you or your business is located in the United States:

You are responsible for complying with all federal, state, and local laws, including those related to data privacy, consumer protection, and online content.

You acknowledge and agree that Brizy is a platform provider, and you are solely responsible for how you use the platform to collect, process, or share any personal data under US privacy laws such as the California Consumer Privacy Act (CCPA) or Children’s Online Privacy Protection Act (COPPA).

You must not use Brizy to collect personal information from children under the age of 13, or under the age required by local law, without verified parental consent.

If you are subject to accessibility obligations under the Americans with Disabilities Act (ADA), it is your sole responsibility to ensure that your websites are accessible to all users.


Note: Certain disclaimers and liability waivers in these Terms may not apply to you depending on your state’s consumer protection laws.


19.2. United Kingdom (UK)

If you are located in the United Kingdom:

These Terms are governed by UK law, and you agree to submit to the exclusive jurisdiction of the courts of England and Wales for any disputes not subject to arbitration.

You agree to comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 when using Brizy to collect or process personal data.

If you are a reseller or agency creating websites for third parties, you are responsible for ensuring that those websites have adequate privacy notices, cookie banners, and data protection practices.

Consumers in the UK may have additional rights under the Consumer Contracts Regulations 2013, including cancellation periods for certain services. Where required, we will respect those rights.


19.3. European Union (EU)

If you are located in the European Economic Area (EEA):

These Terms are governed by EU law and the relevant national law of your country of residence unless otherwise agreed.

You agree to comply with the EU General Data Protection Regulation (GDPR) when using Brizy Services. You are considered a data controller, and Brizy acts as a data processor with respect to personal data processed via your websites.

You must implement appropriate privacy notices, obtain user consent for cookies (per ePrivacy Directive), and respond to user data access or deletion requests in accordance with GDPR obligations.

EU consumers may have the right to withdraw from a paid service within 14 days of purchase under the EU Consumer Rights Directive, and we will honor such requests in line with applicable law.

20.4 Australia

If you are located in Australia, acquire or use the Services in Australia, or Australian law otherwise applies to your use of the Services:


  • Where applicable, you agree to comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles when collecting or processing personal information through Brizy, including applicable requirements for privacy notices, data security, access and correction requests, and overseas disclosures.   • If you use Brizy to send marketing emails or messages, you must comply with the Spam Act 2003 (Cth), including requirements relating to consent, sender identification, and unsubscribe options. ACMA
  • If you use Brizy Shops, you are responsible for your products and services, customer information, advertising, consumer guarantees, refunds, product safety, taxes, and other obligations under applicable Australian law.
  • Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy that cannot lawfully be excluded under the Australian Consumer Law. Any disclaimers, refund restrictions, liability limitations, or dispute-resolution provisions apply only to the extent permitted by law.


20.5 India

If you are located in India, acquire or use the Services in India, offer goods or services to individuals in India, or Indian law otherwise applies to your use of the Services:

  • You agree to comply with the Digital Personal Data Protection Act, 2023, the Digital Personal Data Protection Rules, 2025, and other applicable Indian privacy laws, as and when they are applicable and in force. To the extent that you act as a Data Fiduciary, you are responsible for providing required privacy notices, obtaining valid consent or relying on another ground permitted by law, enabling individuals to exercise their rights and withdraw consent, implementing reasonable security safeguards, engaging processors under valid contracts, deleting Personal Data when it is no longer required, maintaining an appropriate grievance process, and making any legally required data breach notifications. 
  • If you process Personal Data relating to a child, which under the Digital Personal Data Protection Act generally means an individual under 18, you must obtain verifiable consent from a parent or lawful guardian where required and comply with applicable restrictions on detrimental processing, tracking, behavioural monitoring, and targeted advertising directed at children. 
  • If you use Brizy Shops or otherwise offer goods or services to consumers in India, you are responsible for complying with the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, as amended, and other applicable advertising, pricing, product safety, tax, refund, and consumer protection requirements. This includes providing accurate seller, product, price, delivery, return, refund, and grievance information, avoiding unfair, misleading, or manipulative practices, and obtaining consumer consent through an explicit and affirmative action where required.
  • You must comply with the Information Technology Act, 2000 and applicable rules in relation to content and online activities. Brizy may restrict or remove content, suspend access, or take other action where required by applicable Indian law or a valid order from a competent authority. Nothing in these Terms excludes or limits any consumer right or remedy that cannot lawfully be excluded under Indian law.
